STATEMENT
OF CLAIM: Claim  of the Committee that:
1. Carrier violated the effective Agreement
when Trackman F. W. Jones was unjustly dis
missed on March 2, 1979.
2. Claimant Jones shall be paid for eight
hours each work day and holiday, at the
straight time rate of pay for trackmen, to
begin March 2, 1979 and to continue until
such time as he is returned to work.
FINDINGS:  The evidence adduced at the investigation
 
sustained the charge and considering the
 
claimant's poor attendance record and his
 
warnings thereon coupled with the duplicate
 
check offense the penalty of dismissal is not
 
excessive.
AWARD:  Claim denied.
