STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:

(1) The Carrier violated the effective Agreement by failing to
equip the camp car assigned to Roadway Machine Operator
Jesse Rowlett in accordance with Rule 33.

(2) Roadway Machine Cperator Jesse Rowlett, Omaha Division, be
now compensated for his lodging expenses during the month
of May 1958 amounting to $4-1.50 on account of this violation of the Agreement.

FINDINGS : It appears that the claimant complained about his camp car to the
roadmaster, claiming it was filthy, the mattress dirty, no dishes, cooking equipment or water bucket provided and no bathing facilities in it. The roadmaster offered to get dishes and equipment from other cars in the vicinity, told him to use the bath in the foreman's car and otherwise tried to satisfy his complaints, but it appears that he decided he was not going to stay in the car anyway. Rule 33 does not require provision of a mattress and places the responsibility for seeing that cars are kept clean upon the foreman. Under all the circumstances shown in this docket, there is no basis for the claim for reimbursement for lodging expenses.
