SPECIAL BOARD OF ADJUSTMENT N0. 279
BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES
versus
MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT
OF CLAIM: Claim of the Committee that:
1. Carrier violated the effective Agreement when
Assistant B&B Foreman T. J. Ribbing was assessed
thirty (30) days deferred suspension and was not
paid for seven (7) hours on July 24, 1979.
2. Claimant Ribbing shall now be paid seven (7)
hours pay at the straight time rate of pay for
Assistant Foreman and the thirty (30) days deferred
suspension be removed from his personal record.
FINDINGS: It strains one's credulity to believe that all of the
men in the gang were ill from the heat or unable to
work on two occasions within the first couple of hours
of the shift, so we are constrained to find that the
charge was supported by credible evidence.
AWARD: Claim denied.
