MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT
OF CLAIM: Claim of the Committee that:
1. Carrier violated the effective Agreement when
Trackman J. L. McGuire was unjustly dismissed per
notice No. 1179 dated February 5, 1980.
2. Claimant McGuire shall now be reinstated with
seniority rights, pass privileges, vacation rights
unimpaired, as well as restoration of all other rights
and privileges accruing to him which would have been
his under the provisions of various agreements if he
had not been dismissed from the service of the Carrier
February 5, 1980, and be paid for loss of wages suffered
from February 5, 1980, claim to run concurrently until
Mr. McGuire is returned to his job.
FINDINGS: Credible evidence was adduced at the investigation to
support the charge against the claimant so we are constrained to
deny
the claim.
AWARD: Claim denied.
