BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES

versus

MISSOURI PACIFIC RAILROAD COMPANY


STATEMENT
OF CLAIM: 1. Carrier violated the effective Agreement
when Foreman Harold E. Gillis was unjustly
dismissed.

          2. Claimant Gillis shall now be paid for eight

          hours each work day and holiday, at the

          straight time rate of pay for foremen, and

          all other time lost account of dismissal,

          to begin April 18, 1980, and to continue

          until such time as he is returned to service

          with seniority rights and vacation privileges

          restored, unimpaired.


FINDINGS: There was credible evidence adduced at the
investigation to support the charge, and in
view of claimant's relatively short service
and prior discipline, the penalty is not
excessive.
AWARD: Claim denied.
