STATEMENT
OF CLAIM: 1. Carrier violated the effective Agreement when
System Rail Gang Trackmen Allen J. Anderson,
David Bahe,~ Larry Begay, Roy Begay, Roger
Benally, Tom
P.
Bitsue, Buster H. Burton,
Bennie Chee, Disio Chee, Leonard Gonnie,
Paul Jumbo; Jimmie Lee, Tully Lee, Larry
Mexicano, Gilbert Nez, Joe J. Roanhorse,
Justin Robertson, Jerry Sandoval, Jack Begay,
Watson Tolth, Chee J. Topaha, Frank Yazzie,
Gilbert Yazzie and Roger Yazzie were
improperly withheld from service.
2. Claimants shall now be compensated for all
time lost at their respective rates of pay
from June 6, 1980 to June 21, 1980, both
dates inclusive.
FINDINGS: There is no question that the claimants were
insubordinate nor that the proper procedure
under the agreement is to work as directed
and resort to the grievance procedure if
aggrieved by the supervisor's direction, so
the claim cannot be sustained.
AWARD: Claim denied.
