BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES

MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT
OF CLAIM: 1. Carrier violated the effective Agreement when
Trackman Joseph Matthews was unjustly dismissed from service.
2. Claimant Matthews shall now be paid for 8 hours
each work day, including any holidays falling
therein, beginning October 30, 1980, and
continuing until reinstated with seniority,
pass and vacation rights unimpaired.
FINDINGS: The evidence adduced at the hearing shows a
severe physical assault by the claimant upon
his foreman, so there is no valid basis for
sustaining his claim.
AWARD: Claim denied.
