STATEMENT
OF CLAIM: 1. Carrier violated the effective Agreement
when Trackman Driver L. D. Dunn was
unjustly dismissed without being afforded
a fair and impartial hearing.
2. Claimant Dunn shall now be paid for all
time lost at trackman driver's straight
time rate of pay, to begin on August 6,.
1980, and to continue until such time
as he is returned to service with
seniority rights and vacation privileges
restored, unimpaired.
FINDINGS: The claimant did not appear for the
scheduled investigation and the evidence
adduced therein supports the charge, so
there is no valid basis for his claim.
AWARD: Claim denied.
