BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES
versus
MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT
OF CLAIM: 1. Carrier violated the effective Agreement
when Trackman L. Armstead was unjustly
dismissed in letter dated August 27, 1980.
2. Claimant Armstead shall now be paid for
all time lost account of dismissal, to
begin on August 15, 1980 and to continue
until such time as he is returned to work
with seniority rights and vacation
privileges restored, unimpaired.
FINDINGS: Evidence was adduced at the hearing to
support the charge and claimant's prior
discipline record and short service makes
the penalty reasonable.
AWARD: Claim denied.
