STATEMENT
OF CLAIM: (1) Carrier violated the agreement December 9, 1980
as a result of investigation of B&B Foreman
C. A. Johnson, Central Division, for an alleged
failure to properly report for duty and for falsi
fication of his payroll during the last half of
November and first half of December 1980.

(2) Claimant shall now be returned to service and

paid for all time lost at his straight time

rate beginning January 16, 1981, with seniority and

all other rights unimpaired.

FINDINGS: Evidence was adduced at the hearing to support the charge so the claim cannot be sustained.

AWARD: Claim denied.
