BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES
versus
MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT
OF CLAIM: Claim of the System Committee of the Brotherhood that:
(1) The Carrier violated the effective Agreement by assigning
others than B&B employes to the performance of maintenance
work on the Red River Bridge at Alexandria, Louisiana, on
March 30,
1958.
(2)
B&B Employes A. E. Gossett, J. W. Davis, H. F. Carr, W. J.
Foster, B. Walk, F. Beach and 0. G. Mathis be now compensated four hours each at time and one-half rate account
of not being called on March 30,
1958
to perform the work
referred to in Part (1) of this claim.
FINDINGS
: On March
30, 1958,
B&B Foreman O'Neal was called to supervise
section laborers in turning a drawbridge: over the Red River at
Alexandria, Louisiana, to allow passage of boats. The drawbridge is equipped
with continuous rails which have to be removed in order to turn the bridge.
It appears that section forces have always been used to perform that
service and that B&B gangs have never been used to turn this bridge. Under such
circumstances the claim is without merit.
Claim denied.
