OF CLAIM: (1) Carrier violated the agreement on September

8, 1981, following investigation of Machine Operator W. B. Clardy, Northern Division, in connection with the allegation he falsified his time records on August 19 and 28, 1981, while working as timekeeper on Gang 5010 near Pleasant Hill, Missouri.

(2) Carrier shall now return Machine Operator

W. B. Clardy to service with seniority and all other rights unimpaired with pay for time lost beginning October 5, 1981.

FINDINGS: Evidence was, adduced at the investigation to support the charge so the claim cannot be sustained.

AWARD: Claim denied.
