BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES
versus
MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT
OF CLAIM: Claim of the System Committee that:
"(1) Carrier violated the agreement on
August 20, 1981, in dismissing Trackman R. L. Campbell, Central Division,
for alleged insubordination to Foreman
Dennis while working as trackman
unloading.a ballast train near.
Russellville, Arkansas.
(2) Claimant shall now be returned to
service with seniority and all other
rights unimpaired and paid for all
time lost beginning August 20, 1981."
FINDINGS: Evidence was adduced at the investigation to
support the charge. The Carrier's acceptance
of the supervisor's testimony and rejection of that of
claimant is not unreasonable because the supervisor's
testimony that he instructed claimant in the procedure for
closing the doors is supported by the testimony of another
trackman.
Claim denied.
