MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT
OF CLAIM: Claim of the System Committee that:
"Claim in favor of Trackman K. R. Mearron
for pay for all lost time, at his regular
straight time rate, to begin on January 14,
1982 and to continue until such time as
he is returned to service with all seniority
and vacation privileges restored unimpaired,
account dismissal."
FINDINGS: Claimant was informed that he was not entitled to
vacation time but took the time off anyway. This
action is contrary to the proposition that an employee
must work as directed and file a grievance if he considers
the direction to be violative of his contractual rights.
Under these circumstances, the claim is not
sustainable.
AWARD: Claim denied.
