 STATEMENT
 OF CLAIM: Claim of the System Camittee that:

            "1) Carrier violated the agreement on August 9, 1982, when Trackman M. L. White was dismissed for allegedly failing to protect his assignment on July 26, 1982; and a review of his prior discipline record.


          2) Claimant shall now be returned to service with

          all rights unimpaired and paid for all time

          lost inning August 9, 1982."


          FINDINGS: The evidence adduced at the investigation clearly supports the charge and in view of the claimant's prior disciplinary record, the penalty of dismissal is not excessive.
