 BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES
 versus
 MISSOURI PACIFIC RAILROAD COMPANY
 STATEMENT
 OF CLAIM: "(1) Carrier violated the agreement on November 22,
 1983 when Trackman E. Singleton, Northern Division,
 was dismissed for being absent without authority on
 various dates in September and October 1983.
 "(2) Claimant shall now be returned to service with
 all rights unimpaired and paid for all time lost
 beginning November 22, 1983."
 FINDINGS: The evidence adduced at the investigation supported
 the charge. The present claim of double jeopardy was
 not raised at the investigation or on the property. Considering
 Claimant's relatively short service and prior discipline record,
 the discharge, penalty was not excessive.

 AWARD: Claim denied.
