Statement
of Claim: (1) Carrier violated the current working Agreement,
especially Rule 12, when Illinois Division Machine Operator
G. L. Alms was dismissed from the service effective September
7, 1985.
(2) Claimant Alms should now be reinstated and allowed
compensation for all lost wages with seniority, vacation, and
all other rights restored to him unimpaired.
The Board has jurisdiction of this case.
Claimant, on July 19, 1985, was assigned as a Machine Operator on
the Missouri Division. He attended a formal investigation as a result
of an incident on July 19, 1985 on the charge:
"Alleged absence from duty without proper authority,..."
Claimant will be restored to service with all rights unimpaired
but without pay for time out of service and placed in a probationary
status for a six month period. This "last chance opportunity" places
the burden upon Claimant to demonstrate to the Carrier and his Union
that he was worthy of that chance granted to him.
Award: Claim disposed of as per findings.
Order: Carrier is directed to make this Award ff tive within
thirty (30) days of date o 'ssuance suiwr~elow.
