BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES
versus
MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT
OF CLAIM: Claim of the System Committee of the Brotherhood that:
(1) The Carrier violated the effective Agreement by failing
to assign to B&B Mechanics the work of repairing frost
box around water pipes at the north end of Yard C Office
Building at Dupo, Illinois, on October
16, 1958.
(2) B&B Mechanic Helper Charles A. Pankey be now reimbursed
for three

hours pay at his respective rate account
of the violation referred to in part (1) of this claim.
FINDINGS
: In order to make pipe repairs it was necessary for water service
employes to break apart an existing
20" x 18" x 12"
frost box.
After completion of their repairs in reassembling the box they secured a piece
of lumber from the car department wood mill and replaced a rotten board.
It appears that such work was wholly incidental to the water
service repairs they were making. The substitution of one piece of scrap lumber
for one rotten board on the frost box is not evidence that they were performing
carpenters work, but simply that they were properly reassembling the box incident
to the completion of their work.
