SPECIAL BOARD OF ADJUSTMENT N0. 279
Award No. 282
Case No. 282
File 247-7130
Parties Brotherhood of Maintenance of Way Employes
to- and
Dispute Union Pacific Railroad Company
Statement
of Claim: (1) Carrier violated the current working
agreement,
especially
Rule 12, when Trackman Driver F. M. Williams was
dismissed from the
service effective December 3,
1985.
(2) Claimant Williams should now be allowed eight hours pay
for each workday; including any
overtime which
would have
accrued to him and any holidays falling therein, beginning
October 30., 1985, and continuing until reinstated to
service
with seniority, pass and vacation rights unimpaired.
The Board has jurisdiction of this case.
Claimant
received duplicate
pay for the second half of the July
1985 pay period. An investigation
reflected that
Claimant's wife had
cashed the original paycheck.
Thereafter, Claimant
cashed the
duplicate paycheck after contending that he had not
received his
original paycheck.
Sufficient
evidence supports
Carrier's conclusion of Claimant's
culpability of dishonesty. Discharge for dishonesty is reasonable
discipline.
Award: Claim denied.
