Statement of Claim: (1) Carrier violated the agreement Rule 12 when it dismissed Trackman Frank Jacobs effective December 2, 1985.

Claimant Jacobs shall now be allowed eight (8) hours each workday, including applicable holidays and any overtime which would have accrued to him beginning December 2, 1985, and continuing up until reinstated to service with seniority, pass and vacation rights unimpaired.

The Board has jurisdiction of this case.

This case was previously settled by the parties and withdrawn from before the Board.
