Statement
of Claim: (1) Carrier violated the current working agreement,
especially Rules 1, 2 and 11, in that Bulletin Nos. 36 and
37 dated February 7, 1986, were for machine operators on
spike drivers. These two bulletins did not list the numbers
of these machines.
(2) Carrier also violated the above-quoted rules account
Bulletin Nos. 38, 39, 40, 41 and 42 have been bulletined
as jobs of the Eastern District Tie Gangs. These jobs are
Division jobs and should be bulletined as such.
(3) We are therefore requesting that these jobs be rebulletined to the respective Division working with the
District Tie Gang, and the machines be re-bulletined listing
the numbers.
Findings: This Board has jurisdiction by reason of the Parties
Agreement of January 5, 1959.
This is the third in the series of similar cases
referred to our Board. Those cases were decided by our
Awards Nos. 288, 294, and 298 the findings of which by
reference are incorporated herein.
Employee objection was made to Bulletins Nos. 36
through 42 that were bulletined February 7, 1986.
Bulletins 36 and 37 were objected to because Carrier did not
list the machine numbers for Spike Drivers for Machine
Operators. While Bulletin 38, 39, 40, 41 and 42 were
objected to because the Carrier bulletined them only to the
District Tie Gang instead of to the Division.
The issue raised was previously decided in our above
cited Awards Nos. 288, 294 and 297 and are followed herein.
