Statement
of Claim: (1) Carrier violated the current working agreement,
especially Agreement Rules 1, 2 and 11, account Bulletin
Nos. 51, 52 and 53 dates March 3, 1986, on District Tie Gang
5860 did not list the machine numbers.
(2) Carrier also violated the above-quoted Rules as Bulletin
Nos. 46, 47, 48, 49, 53 and 54 are Division jobs which have
been bulletined in error to the District Tie Gang. Area
jobs such as these (support gangs) should have been
bulletined to the respective Division on which the District
Tie Gang is performing.
(3) Therefore, we are requesting that these jobs be rebulletined to the respective Division and that the machines
be re-bulletined listing the machine numbers.
Findings: This Board has jurisdiction by reason of the Parties
Agreement of January 5, 1959.
This is the
fourth
of the series of similar cases
referred to our Board. Those cases were decided by our
Awards Nos. 288, 294 and 297, the findings of which, by
reference, are incorporated herein.
Case 298 refers to Bulletins 46, 47, 48, 49, 51, 52, 53
and 54 as being improperly bulletined to the Eastern
District Tie Gangs on March 3, 1986.
Bulletins 51, 52 and 53 were for Machine
Operators/Helpers on Eastern District Tie Gang 5860 because
they did not include the machine number thereon. The Board
decided that issue in Award Nos. 288, 294 and 297, the same
is followed herein.
The other bulletins were alleged to have been in error
as they went to the District Tie Gang and not to the
Division. Our Awards 288 and 294 decided that issue and
same is followed herein.

Order: Carrier is directed to make this Award effective within
thirty (30) days of date of issuance shown below.
