STATEMENT
OF CLAIM: Claim of the System Committee of the Brotherhood that:
(1) The Carrier violated the effective Agreement by failing
to call for overtime work on Sunday, September
7, 1958,

B&B Foreman Helvering be now paid for

hours at his respective
Foreman's rate and at time and a half on account of the violation referred
to in Part 1 of this Claim.
FINDINGS
: On Saturday, September
6, 1958,
a derailment occurred and the Bridge
and Building Supervisor was requested to furnish bridge men to assist
section men in repair to track because not enough section men were available.
It also appears that the bridge work required in that emergency could be and was
deferred until Monday and was performed by claimant and his gang. Under those
circumstances it does not appear that there was any need for a B&B Foreman for
the emergency work Saturday night.
