 Statement
 of Claim: (1) Carrier violated the Agreement, especially Rule 12,
 when Trackman S. J. Sampson was assessed a 30 day
 deferred suspension.

        (2) Claim in behalf of Trackman Sampson for removal of discipline from h5^. Sampson's record.


        Findings: The Board has jurisdiction by reason of the parties Agreement establishing this Board.


        Claimant Trackman suffered a personal injury on Friday, September 12, 1986 at approximately 12:20 PM. He reported the injury on Monday, September 15, 1986. As a result of a formal investigation he was assessed the discipline here appealed.


        The record reflects that Claimant did try to contact people on Friday. He reported it properly and promptly on his return to work Monday. In the circumstances surrounding this particular claim it shall be sustained.


Award: Claim sustained as per findings.

        Order: Carrier is directed to make this Award effective within thirty (30) days of date of issuance shown below.
