BROTHERHOOD
OF
MAINTENANCE
OF WAY
EMPLOYES

versus

MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT
OF CLAIM
: Claim of the System Committee of the Brotherhood that:

(1) The Carrier violated the effective Agreement by failing to

equip camp cars of Extra Gang of Robert Boswell, as provided

in Rule
33.

(2) Extra Gang Foreman Robert Boswell be reimbursed for actual

expense incurred for meals and lodging during the month of

January,
1958,
in the amount of
$121.00
on account of this

violation of the Agreement.
FINDINGS
: The camp car assigned to Extra Gang Foreman Robert Boswell involved

in this case was fully repaired at the Palestine shop on September
25, 1957,
and the claim is in part predicated upon a letter written by Boswell
on June
14, 1957,
about another car. It is also shown that the reports of
another foreman about the same car for February and succeeding months in
1958
rated its condition as good.
Complaint is made that no stove or cooking utensils were provided,
but there is no evidence that he ever requested that the same be provided and
the rule does not require the furnishing of such equipment as a matter of course.
The evidence presented in this case does not ,justify the claim.
AWARD
: Claim denied.
