Statement
of Claim: Claim on behalf of Trackman L. A. Cotton, SSN: 439-25-8106
for eight(8) hours each workday beginning June 29, 1989
account he was the assessed a 90 actual day suspension
during the period July 14 through October 11, 1989.

        Findings: The Board has jurisdiction of this case by reason of the parties Agreement establishing this Board therefor.


        Claimant admitted (T-17) that he was absent without first seeking and receiving permission therefor.


        The admission of guilt leaves the Board with no recourse but to deny the appeal.


        However, while the discipline will stand the Claimant is to be paid for the period of work time between June 29 and July 14, 1989. This claim is otherwise denied.


Award: Claim disposed of as per findings.

        Order: Carrier is directed to make this Award effective within thirty (30) days of date of issuance shown below.
