STATEMENT
OF CLAIM: Claim of the System Committee of the Brotherhood that:
(1) The Carrier violated the Agreement by assigning to the Lamp
Tender at Jefferson City, Missouri, the oiling of switches,
which work is that of a Section Laborer, on or about March
19,
1958.
(2)
Section Laborer Hubert Schmitz be now compensated a day's pay
of eight hours at his pro-rata rate for October
29,

19,

26,
December
3,
December 10, and December
17, 1958,
and any subsequent dates that the Lamp Tender oiled
the switches as referred to in Part 1 of this claim.
FINDINGS: In this case the lamp tender at Jefferson City was assigned some
work of oiling switches to fill out his time, which amounts to no
more than

hours per week. The Lamp Tender position is simply a higher ranking
section laborer job and we find no provision of the agreement that would restrict
the assignment to him of some small amount of section laborer duties to fill out
his time.
