SPECIAL BOARD OF ADJUSTMENT N0. 279

BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES

versus

MISSOURI PACIFIC RAILROAD COMPANY

AWARD N0. 50

STATEMENT
OF C7 AIM: Claims of St. Louis Terminal Division B&B Employes J. H. Woodcock,
Barnet' Humes, and P. E. Isam for reimbursement of transportation
expenses St. Louis, Missouri, to Dupo, Illinois, during the period
September 3, 1958, to September 26, 1958, incl. account required to
travel outside the city limits of the City of St. Louis, claims as
follows:

Howard Woodcock
Barnet' Humes
P. E. Isam

B&B Foreman $17.10
Asst. B&B Foreman 15.40
B&B Carpenter 15.80

FINDINGS: It appears that in the past there were three B&B Department gangs on
the St. Louis Terminal Division, one at Dupo, a shop gang at Compton
Avenue, St. Louis, and a division gang west of the river (St. Louis). At that
time the division gang was permitted to start and quit the day's work at the
nearest public transportation point at the city limits to the work site outside
the City of St. Louis proper. On June 24, 1957, those gangs were abolished and
there was established a shop gang at Compton and a 3t. Louis Terminal Division
gang. Effective September 3, 1958, this terminal gang was instructed to assemble
at their tool car which had been moved to Dupo, Illinois, a point within the St.
Louis metropolitan area and within the St. Louis Terminal. They now claim trans
portation expense in this case and travel time allowance in Docket MW-51. We note
that Rule 25 provides that

It is not reasonable to say that the former practice of limiting assembling points to the St. Louis city limits for a gang established to work west of the river (City of St. Louis) is now applicable to the revised gang advertised to cover the entire St. Louis Terminal. In view of the provision of that rule that different assembling points may be designated and its prohibition of time allowance from the employes' home thereto, it appears that the claim is without merit. That determination is confirmed by awards of the Third Division, National Railroad Adjustment Board, No. 4527 and No. 5886.

AWARD : Claim denied.
