Statement
of Claim: (1) Carrier violated the Agreement, especially Rule 12,
when Trackman T. M. Harris was dismissed on October 4, 1990.
(2) Claim on behalf of Mr. Harris for wage loss suffered,
until reinstated with seniority, vacation and all other
rights unimpaired.
Findings: The Board has jurisdiction of this case by reason of the
parties Agreement establishing this Board therefor.
The Claimant, Trackman T. M. Harris, following a formal
investigation held on August 16 and 19, 1990 on the charge:
"Your reporting for work under the influence of an alcoholic
beverage, when working as a trackman on Gang 3533 at Prairie
Du Rocher, IL."
was found to be culpable. He was dismissed from service as
discipline therefore.
The Claimant was accorded the due process to which
entitled under Rule 12.
There was sufficient competent and probative evidence
adduced to support the Carrier's conclusion of culpability.
The discipline imposed for a Rule G violation of
dismissal is found to not be unreasonable in this case.
Award: Claim denied.
