Statement
of Claim: (1) Carrier violated the Agreement, especially Rule 12,
when Clarence Joseph was assessed 30 days deferred
suspension.
(2) Claim in behalf of Mr. Joseph for removal of said
discipline from his record.
Findings: The Board has jurisdiction of this dispute by reason
of the Parties Agreement establishing this Board therefor.
The Claimant Trackman was involved in Award No. 576
which by reference is incorporated herein. The Claimant was
charged with not properly reporting an injury sustained on
October 9, 1991 until October 14, 1991. He was given a
thirty day deferred suspension following a formal
investigation referred to in Award No. 576.
Claimant was accorded the due process to which
entitled. There was sufficient evidence adduced to support
the conclusion of Carrier. The discipline is most
reasonable in light of the circumstances. The claim will be
denied.
Award: Cla*m denied.
