BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES

versus

MISSOURI PACIFIC FAILROAD COMPANY

STATEMENT OF CTAIM: Claim of the System Committee of the Brotherhood that:

(1) The Carrier violated the effective Agreement by declining to
reimburse Roadway Machine Operators D. H. Turner, A. D. Lively
and J. B. Herriage for their expenses incurred during the month of April, 1959,
while assigned to work at Italy, Texas.

(2) The carrier now reimburse these named Claimants in accordance with their respective expenses accounts as submitted for April, 1959.

FINDINGS: The Agreement contains no provision regulating the location of the head
quarters for Roadway Machine Operators and provides expenses only when
away from headquarters. The bulletin in this case clearly stated the headquarters _
location; there was no protest thereof at that time and the men freely bid for the
jobs under the conditions stated in the bulletin. Accordingly, the claim is with
out merit.
