Award No. 134 Case No. 215 PARTIES TO DISPUTE:

St. Louis - Southwestern Railway

and

Brotherhood of Maintenance of Way Employees

STATEMENT OF CLAIM:

"I. Carrier violated the Maintenance of Way Agreement, especially but not limited to Rule 6'- Discipline and Grievances, when they dismissed Mr. Sterling Flowers for being absent on March 16, 1976, which was excessive punishment.

"II. Laborer Sterling Flowers be paid for all

time lost beginning March 17, 1976, to continue

until date of reinstatement. We request that

he be reinstated with seniority, vacation and

all other rights unimpaired."

FINDINGS:

On the basis of the record before it, the Board

finds that dismissal under the circumstances was excessive.

Accordingly, Claimant shall be reinstated with seniority

unimpaired, but with no pay for time lost.

AWARD

Claim disposed'of per findings.
