STATEMENT OF CLAIM: -
1. The Carrier violated the Agreement when on or about
May 8, 1961, it allowed Assistant Bridge and Building Inspector
Lewis Gassoway to work as welder helper in making repairs to
Castor River Bridge instead of recalling a welder helper.
2. Senior furloughed Welder Helper H. C. Cash shall be
paid for total number of hours that Assistant Bridge and Building
Inspector Gassoway worked as welder helper beginning on or about
May 8, 1961.
FINDINGS:
Upon the whole record and all the evidence, after hearing,
the Board finds that the parties herein are Carrier and employee
within the meaning of the Railway Labor Act, as amended, and that
this Board is duly constituted by agreement and has, jurisdiction
of the parties and of the subject matter.
From the evidence of record the Board finds that the
organization failed to show what work was performed by the Assistant'
Bridge and Building Inspector that was a,WeldersHelper work.
AWARD:
Claim denied.
