STATEMENT OF CLAIM
:
1. The Carrier violated the effective Agreement by
assigning a Plumber and a Helper, employes outside
the Scope of the effective Agreements, to the per
formance of carpenter work in the building of a
sedimentation box at Pier
6,
Shore Road, Port Richmond,
Philadelphia, on June
6
and
7, 1960.
2.
All Carpenters or Wharfbuilders holding seniority
rights to the performance of this work referred to be
now paid their pro rata share of a number of hours
equivalent to the number spent by the Plumber and his
Helper in performing this work.
OPINION OF BOARD
:
On June
6
and
7, 1960,
in connection 'with the installation of a sewage disposal
line at Port Richmond, Pa., the Carrier built a sedimentation or drainage box at
Pier
6
along Shore Road, Fort Richmond, Philadelphia, Pa. There is a
6"
sewage line
running into the box and another line running out so that the sediment drains into
the Delaware River. On June
6
four carpenters were assigned to the work and on
June
7
two carpenters were assigned to complete the work. A plumber was also
assigned to the job site on these days. Although the claim refers to a plumber
helper, there is no evidence in the record that such an employee was on duty at
this location on the subject dates.
The record discloses that the Carrier assigned a sufficient number of carpenters on the days in question to perform the available work of their craft at
this location. It also was necessary to have a plumber on duty at the site of the
job. The record is vague on the specific details of the work performed by the
plumber but there is no showing that he was used to deprive any carpenters of work
accruing to the carpenter craft.
