1. The Carrier violated the effective Agreement when during the period
of April 10 to April
20, 1961, it
assigned a contractor to remove
the copper drip pans under Track No.
6
at the Reading Terminal,
Philadelphia, Pa.
2. Tinsmiths covered
by
the Scope of this Agreement be now paid a pro
rata share each of a number of hours equivalent to the hours spent
by
the contractor performing this referred to work.
OPINION OF BOARD
:
The record discloses that the removal of copper drip pans on all Reading
Terminal tracks, expect Track
6,
was performed by B&B tinsmiths. The work performed
by the outside contractor in removing copper drip pans from Track
6
was identical
to the corresponding work done on the other tracks. We conclude that under the
controlling Agreement the subject Track
6
work should have been performed by the
claimants.
