STATEMENT OF CLAIM:
1. The Carrier violated the effective Agreement on November
4, 8,
and
13, 1963,
by assigning or otherwise permitting a Car Puller to
paint the cable at Pier
14,
Port Richmond, Philadelphia, Pa.
2.
The Foreman and the Painters in his crew, under the Scope of this
Agreement shall now be compensated for their pro rata share of the
number of hours consumed by the Car Fuller in performing this work
on November
4, 8,
and
13, 1963.
OPINION OF BOARD:
This claim protests the Carrier's action in assigning a Car Puller to
paint the car haul cable at Pier
14,
Port Richmond, on the dates indicated
above. The evidence convinces us that the disputed task is painter's work.
Accordingly, the claim will be sustained.
AWARD: Claim sustained.
