STA.T' OF CLAIM:
1. The Carrier violated the effective Agreement when it assigned Extra
Gang Laborers to pull and reset spikes on switches and slips at
Diamond Street, and also at Brown Street interlocking, on October
27, 1963,
in lieu of calling out Section Foreman A. Palumbo.
2.
Section Foreman A. Palumbo be now compensated seven and one-half
hours at his time and one-half rate, account of the Carrier's violation of the Agreement on the referred-to date.
3.
Section Laborers Clarence Miller and William Butler be now compensated

hours each, at their respective rate, on account their not
being called for work on their assigned Section.
OPINION OF BOARD:
In accordance with the principle expressed in the Opinion of Board in
Award No.
52,
the instant claim will be denied.
