STATEMENT OF CLAIM:
1. The Carrier violated the effective Agreement when on December
23,
1963,
it assigned or other~rise permitted members of a train crew
to clean snow from switches at Boyertown and Barto, Pa., on the
Colebrookdale Branch.
2.
Maintenance Gang Foreman H. Imbody and Laborers D. Fusco and C.
DiCicco be now paid 6-1/2 Iaours each at their respective time and
one-half rate account of this violation of the agreement.
OPINION OF BOARD:
Based on U. S. Weather Bureau information that the snow was turning to
rain, the Carrier in good faith released the claimants at the end of their
regular tour of duty. The fact that several hours later the traveling awitcher
crew was required to clean certain switches for the movement of its own train
was a condition which could not be foreseen at the time that the claimants
were released.
AWARD: Claim denied.
