STATEMENT "Claim of the System Committee of the Brotherhood that:
OF CLAIM:
(1) The Carrier violated the effective Agreement when it assigned
track forces instead of B&B forces to assemble and place corrugated steel pipes as
the ultimate replacement of Bridge No.
3744
at Bliss, New York.
(2) Carpenters Russell H. Carr, James McGarvey, Martin Zawatski,
Lloyd L. Cochran, Floyd R. Conner, Peter R. Brown, Corydon Manning and Carpenter
Helpers Harry F. Murphy and Moxie Kryniski each be allowed sixteen (16) hours, pay
at their respective straight time rates account of the violation referred to in
Part (1) of this claim."
FINDINGS: We have a joint statement of facts, which need not be recited here.
We have read the submissions of the parties, particularly the Awards
cited by the Organization in support of its position.
The items of work here involved are:
1. Unloading pipe.
2. Digging trenches.
3.
Connecting and placing pipe in a fill.
4.
Shoveling dirt, previously removed, around pipes.
We fail completely to see where this is work belonging to B&B forces.
On the contrary, it definitely is the kind and type of work customarily performed
by track forces.
The claim will be denied.
