THE CENTRAL RAILROAD COMPANY OF NEW JERSEY
STATEMENT OF CLAIM:
That the Carrier violated the effective agreement when during the period
August 10th to August 28th, 1959, it assigned Motive Power employees to
erect a two-story steel platform at the Power House, Elizabethport, N. J.
That the two senior furloughed Ironworkers and senior furloughed Welder
now each be reimbursed for the equivalent amount of hours consumed by
the Motive Power employees in performing this work during the period
August 10th - 28th, 1959.
OPINION
OF BOARD:
This claim involves the assignment of three shop craft employees (two
boilermakers and a welder) to erect a two-story steel platform in the Power
House at Elizabethport. The Power House is under the supervision of the Motive
Power Department. The platform was erected around a boiler to provide access
for purposes of inspection and maintenance. The parts for the platform were
obtained by dismantling a lancing platform formerly located outside the same
Power House. The contention in this claim is that the subject erection work
should have been performed by two ironworkers and a welder belonging to the
B&B forces covered by the Maintenance of Way Agreement.
Since the work in dispute consisted of erecting an inspection and maintenance platform for a boiler in the Power House, and since this platform is
not an integral part of the building structure, it must be concluded that M of W
Bridge and Building Department employees do not have exclusive jurisdiction over
the work.
