STATEMENT OF CLAIM
:
That the Carrier violated the effective agreement when on January
19,
1960,
they assigned a Track Laborer to perform Crossing Watchmen
duties on Broadway Crossing, Long Branch, N. J.
That the senior extra crossing watchman who filed for extra and relief work under the provisions of Exhibit No.
9
of the Working
Agreement or Crossing Watchman Joseph Stroffolino, the regularly
assigned employee, now be reimbursed in the amount of one "CALL"
for work performed by a Track laborer on January
19, 1960.
OPINION OF
BOARD:
At about b:00 P.M. on the date of the claim, the gates at Broadway Cross
ing (Long Branch, N. T.J became inoperative due to" a broken cable. Track laborer
B. Rego, who resides four blocks from the crossing, was called at 8:50 P.M. to
give the regular Crossing Watchman assistance in protecting the crossing. The
Track laborer 'was released at 10:30 P.M. Crossing watchmen are in a separate
sub-department and are on a seniority roster separate from that of track laborers.
The seniority of these two employee categories is not interchangeable. The con
fronting claim is based upon the contention that a crossing watchman should have
been called to render the assistance for which a track laborer was called.
The Carrier was confronted with an emergency situation in the subject instance. Because of this fact, we find no merit in the claim.
