THE CENTRAL RAILROAD COMPANY OF NEW JERSEY
STATEMENT OF CLAIM
:
(1) The Carrier violated the effective agreement on April 10, 11
and
12, 1958,
by assigning Carmen to construct and paint a new
door for the machine shop at the Communipaw Engine Terminal.
(2) The B&B Carpenters and Painters of the Structures Department
who would have been assigned to this work at Communipaw Engine
Terminal be now paid at their respective pro rata rates for an
equal number of hours as were worked by the Carmen in the
performance of the work referred to in Part (1) of this claim.
OPINION OF BOARD
:
Mechanical Department employes in the Carmen's craft constructed a door with
dimensions of

by 10'

and gave it a prime coat of paint. This door was
then installed in the Machine Shop, Communipaw Engine Terminal, by B&B Carpenters.
Claim is made that the Carrier violated the subject agreement by assigning the
building of this door to employes in the Carmen's craft.
The door in question was of custom size, as is evident from its dimensions.
While the Carrier's Carpentry Shop builds doors of ordinary sizes, it is not
equipped to make a door of this dimension. The evidence also discloses that Mill
Shop Carmen have previously constructed doors for use in the Carrier's facilities.
Under these circumstances, we conclude that no Agreement violation occurred in this
instance.
