STATEMENT
OF CLAIM:-
"Claim of the General Committee of The Order of Railroad Telegraphers
on The New York, New Haven & Hartford Railroad, that:
1. The Carrier violated the provisions of the agreement between the
parties when, commencing on Monday, October 7, 1957 and continuing
on subsequent dates, it required or permitted the conductor of
Crane H-55 to report times of arrival and departure of his train,
obtain permission to occupy the block and to copy motor hand car
messages at Middlefield,
Connecticut.
2. The Carrier shall be required to compensate J. S. Hills or other
senior idle telegraphers, extra in preference, who may be determined
to be entitled, for eight hours on each day commencing October 7,
1957 and continuing thereafter until the violation ceased."
FINDINGS:
This claim involves the actions of a conductor on a work crane,
temporarily headquartered at Middlefield where no operator is located,
using a telephone to report to and obtain information from the
operator in charge of the block. Such use of the telephone is a
substitute for going to the telegraph office or having a messenger
bring the information to him. It is not a violation of the
telegrapher's agreement.
