                      The Order of Railroad Telegraphers and

            The Pennsylvania Railroad Company


    STATEMENT OF CIAIM: "Claim of the General Committee of The Order of

    Railroad Telegraphers that Block Operator W. D.

    Wells be allowed a call, or an available Extra Operator, a day's pay

    account train orders 5, 6 and 7 being telephoned to train crews at

    Morrow, Ohio block office, during the hours this office was closed;

    various subsequent dates when train orders have been telephoned to

    this point during the hours that the office has been declared

    closed." (Cincinnati Division Case No. 79 - System Docket No. 306)


                  FINDINGS:


Award 153 directs that train and engine service employees on this Carrier shall not be required to copy train orders except in emergencies, at points where, and during the hours when, Block or Telegraph or Telephone Operators are scheduled to be on duty, or at block stations which have been closed or abolished since May 1, 1938, or at block limit stations which have been established since May 1, 1938 or may in the future be established.

We have reviewed Employees' Exhibit H and find the following do not constitute an "emergency," within the meaning of Arbitration Award No. 153; and are therefore payable:

Claims covered by Employee's Exhibit Numbers H-3, 4, 5, 6, 7, 8, 9, 10, 11, 13, 14, 15, 16, 17, 20, 21, 22, 23, 25 and 27.

    AWARD:


    Claim sustained for those enumerated in findings.
