STATEMENT OF CLAIM: "Claim of the Order of Railroad Telegraphers on the Penn
sylvania Railroad, Cincinnati Division, that on Saturday,
September 26, 1953, the agency at Norwood Freight Station was changed from a
five-day position to a six-day assignment, and that an employe not covered by
the Agents' agreement was assigned to work on Saturday and to perform work that
is normally performed by the Assistant Agent when he is on duty. A change in
the relief days of the employe not covered by the Agents' agreement was made to
fill the position on Saturday. Claim is hereby made for pay on a 'call' and
overtime basis for J. M. Sigler equal to the hours worked by the employe used to
cover this assignment for Saturday, September 26, 1953, and for each subsequent
Saturday this method of filling the position is permitted." (Cincinnati Case

FINDINGS:
Here Carrier is in violation of the Agreement. It cannot assign Agent's
work on Saturday of a 6 day assignment to an employee not covered by the Telegraphers' Agreement.
AWARD:
Claim sustained.
