STATEMENT OF CLAIM
: "Claim of the General Committee of The
Order of Railroad Telegraphers,
Pennsylvania Railroad, that:
E. C. Johnson, Block Operator, is entitled to receive the difference between the pro rata rate,
which was allowed, and the time and one half rate which was
denied, account of services performed on her regular position
at Frank Block Station, June 11, 1957. The date in question
being the sixth consecutive work day on which Mrs. Johnson
performed service, through no choice of her own, Regulations
4-F-2, 4-J-1 and 5-G-1 (j) governs." (Southwestern Region
Case No. 46-A - System Docket No.441)
FINDINGS
:
Claimant here had begun what was her regularly assigned workweek on
Thursday, June 6. Her fifth consecutive workday was Monday, June 10, after
which had followed her previously assigned rest days on Tuesday and Wednesday.
However, Carrier had, on June 3 notified Claimant it was changing,
effective 12:01 a.m., Tuesday, June 11, 1957, the rest days of her position
from Tuesday and Wednesday to Wednesday and Thursday.
Claimant was thus required to work on Tuesday, June 11.
Organization asserts June 11 was the sixth day of her workweek and
she was, under Regulation 4-F-2, among others, entitled to payment at time and
one-half for Tuesday, June 11. We agree.
