STATEMENT OF CLAIM:

"Claim of the General Committee of the Order of Railroad Telegraphers, Hbg., District, Phila. Reg., that when on March 4, 1958 the transmittal of certain Teletype Reports, formerly handled by clerical employes at Reify St. Yard Office, Hbg., Pa., was transferred and assigned to Enola, Pa., West End Teletype Office, to be performed by Telegraphers at that location it, thereafter, became an integral part of the assigned duties of the Printer Operators at Enola, and when these duties were taken away and diverted to Reily Street Yard Office for transmittal by clerical employes, beginning with May 3, 1958, such action constituted a transfer of work which then belonged exclusively to employes covered by the applicable Agreement, to employes not covered by said Agreement, same is considered as a violation of the Scope Rule of the Telegraphers' Agreement and as a continuing violation thereof, as described in Item 3 of Article V of the Agreement of August 21, 1954. Accordingly, as a consequence, the Carrier shall allow to an idle, available, qualified extra employe, eight (8) hours compensation for any and all reports transmitted by employes, other than those covered by the Telegraphers' Agreement, from Reily St. Yard Office, during any eight (8) hour period of any twenty-four (24) hour period, beginning with May 3, 1958 and until such time as said violation is corrected by the return of the work in question to employes covered by the Telegraphers' Agreement presently assigned to Enola, Pa., or by the establishment of Printer Operator positions at Reily St. Yard Office and assignment of Telegraphers to perform such duties. In the absence of an extra employe on any particular day (8 hr. period) the senior qualified available regularly assigned employe shall be compensated on a call basis account of said violation. Eligibility of claimants to be determined by a joint check of the Carrier's records; employes presently to be considered as claimants in the instant case are, R. L. Shank, J. R. Stare, B. A. Weil, J. R. Walters, J. K. Griffith, W. M. Peterson, L. W. Bostwick, S. V. Yarnell, F. D. Reidlinger, J. H. Spohn, W. G. Carlson, G. J. Dunlevy and C. C. Lamb, all of whom have initiated claim by presentation of time cards for alleged violation, and which have been disallowed by the Wire Chief, Mr. 0. P. Keller, in letter to claimants dated June 10, 1958." (Philadelphia Region O.R.T. Case No. 157 - System Docket No. 568)

FINDINGS:

For at least 30 years,teletype reports of the consist of trains dispatched from Harrisburg have been transmitted by clerical employees from yard offices in that area. One such location is Reily Street Yard Office where, Carrier states, clerical employees have performed such teletype work continuously since the installation of teletype equipment in 1929; that clerical position Symbol G-206 existed at Reily St. Yard Office, partial duties of which are:

"checking and preparing interchange reports and handling correspondence in connection therewith; operate teletype; maintain yard operation records; taking and transcribing statements, trials, etc."

Carrier abolished Position G-206 effective March 1, 1958 and some of the work of handling teletype reports was transferred to the West End Office at Enola where it was performed on first, second and third tricks by Printer Operators coming within the Scope of the Telegraphers' Agreement.

Carrier says it found that it had erred, and on May 3, 1958 the teletype work that had been transferred to the West End office at Enola was returned to Reily St. Yard Office where it was assigned to classification Clerks on first, second and third tricks.

Carrier's action is not violative of the Telegraphers' Agreement as charged; in fact, it is sanctioned by paragraph 2 of Decision 42, Telegraphers' Reviewing Committee.
