STATEMENT OF CLAIM
-. "Claim of the General Committee of the O.R.T. that the Car
rier violated the Rules of the Agreement, Rule 4-G-1,
4-H-1 (b), 5-G-1 (a), (b), (c), (f) and Decision No. 2 of the Forty-Hour-Week
Committee by blanking the leverman positions at the following locations on Dec
ember 25, 1958 and January 1, 1959 and required the Block operators to absorb
and perform the work of the levermen which is performed by the levermen during
their work week-.

'Hudson' - 1st trick - J. E. Stryker

Same violation occurring at 'A' Tower when the Assistant Train Directors'
positions were blanked on the first and second tricks on December 25, 1958 and
January 1, 1959 and required the Train Directors to absorb and perform the work
of the Asst. Train Directors which is performed by them daily during their work
week. The incumbent on the first trick J. L. Smith and J. Wall on the second
trick.

"Claim is made in accordance with Article 5 (a) of the August 21, 1954
Agreement on behalf of the above named employes for a day's pay at the overtime
rate of pay account being suspended from working on a day of their regular assigned work week while the work remained to be performed as on other days of
their work week. Further, claim is made on behalf of the above named employes
or incumbents for all subsequent holidays when the positions are allegedly
blanked." (New York Region Case No. 5/59 - System Docket No. 657)
FINDINGS*
Carrier's action here is specifically permissible under Regulation 4-H-1
(a) and supported by Awards 8705 and 8706.
Claim will be denied.
