STATEMENT
OF CLAIM:
SPECIAL BOARD OF ADJUSTMENT N0. 327
THE ORDER OF RAILROAD TELEGRAPHERS
READING COMPANY
CASE N0. 2
"Claim of the General Committee of The Order of Railroad Telegraphers on
the Reading Lines (Reading Company), that:
1. Carrier violated the Agreement between the parties when, effective
September 22, 1958 it declared 'abolished' the positions of AgentTelegrapher at Boyertown and Pennsburg-East Greenville, Pa., when in
fact the work of such positions remained and was required to be performed daily thereafter.
2. Carrier violated the Agreement between the parties when commencing
September 22, 1958 and continuing thereafter, it merged, combined and
consolidated the work, services and duties of the position of AgentTelegrapher at Boyertown, Pa. with the work, services and duties of the
position of Agent-Telegrapher at Pennsburg-East Greenville, Pa., and
required one Agent-Telegrapher to divide his time between the two stations located 12 miles apart.
3. Carrier shall be required to restore the full time agency positions
at Boyertown and Pennsburg-East Greenville to a minimum eight hour
daily basis as each existed prior to September 22, 1958.
4. The regularly assigned occupant of Boyertown agency, Mr. C. S. Gerhart and Mr. P. D. Mohr at Pennsburg-East Greenville, who weYe thus improperly removed from their assigned positions, shall be restored thereto and be compensated in full for all monetary loss resulting from the
Carrier's improper action in removing them from their regular assignment, and also paid for all expenses incurred as well as travel and
waiting time while working other positions until restored to their regular assigned positions.
S. All other employes displaced as a result of violation hereinbefore
set out shall be compensated in the same manner as outlined in paragraph 4.
6. The senior idle employe, extra in preference, shall be paid one
day's pay at the applicable rate at Boyertown and Pennsburg-East Greenville on each and every day beginning September 22, 1958 and continuing
thereafter until such violation is corrected.
7. Joint check of Carrier's records be ordered to ascertain and verify
the names and amounts due employes as set forth herein."

FINDINGS:
This case is similar to case No. 1. By notice dated September 11,
1958 the positions of Agent-Telegrapher at Boyertown and Pennsburg-East
Greenville were abolished effective September 22, 1958. At the same
time a dual agency position was advertised by bulletin effective the
same date. Clerical positions were maintained at both stations before
and after September 22, 1958.
Hence the findings and award in Case No. 1 govern the disposition
of this claim.
AWARD: Claim sustained to theextent stated in the findings in Case No.
1 before this Board.
