1. Carrier violated the Agreement between the
parties when beginning February 1, 1958 it
transferred work of the agent's position at
Meyersdale, Pennsylvania to persons not
covered by the Agreement.
2. Carrier shall compensate the occupant of the
position of agent at Meyersdale, Pennsylvania
in the amount of one hour and thirty minutes
at the time and one-half rate on each day
this violation occurs beginning with February
1, 1958 and continuing thereafter until the
violation is corrected.
The circumstances in this claim differ from those in Docket No. 99
only to the extent that the mail handling here involved was previously handled
by the operator outside his assigned hours.
It is, thus, mail handling work which falls squarely within Interpretation No. 4 to Supplement No. 13, United States Railroad Administration, and a
denial award is required.
